Eksistensi Gerakan Sosial Pasangan Campur Antarnegara: Upaya Memperoleh Hak Untuk Menikah di Masa Pandemi

  Abstract


Pasangan campur antarnegara yang tidak terakomodasi oleh kebijakan keimigrasian membentuk gerakan #loveisnottourism di media sosial. Artikel ini bertujuan mendeskripsikan berbagai hal yang melatarbelakangi munculnya gerakan sosial #loveisnottourism dan pemenuhan hak untuk menikah dalam konteks undang- undang yang mengatur hak asasi di Indonesia saat pandemi. Penelitian ini dilakukan melalui metode penelitian kualitatif deskriptif dan pendekatan yuridis normative dengan menganalisis data hukum primer dan data sekunder. Faktor pemicu gerakan sosial #loveisnottourism dikategorikan menjadi faktor personal dan faktor eksternal. Ketiadaan fasilitas keimigrasian bagi pasangan campur untuk bertemu dan melaksanakan pernikahan merupakan pengejawantahan doktrin positif hukum tentang hak asasi di Indonesia, yang mengkategorisasikan hak untuk menikah di saat pandemi sebagai bagian dari derogable rights. Hak tersebut dapat dibatasi pemenuhannya oleh negara dengan mempertimbangkan kondisi kesehatan dan keamanan negara dari sebaran Covid-19. Artikel ini merekomendasikan perlunya penjelasan yang transparan mengenai doktrin positif hak untuk menikah sebagai derogable rights sehingga pemenuhannya dapat dibatasi.
